6. Medical Information and Treatment Consent
You are responsible for providing accurate, complete and up-to-date information about your health, medical history, injuries, medications and any other relevant circumstances before treatment.
You must inform your practitioner of any changes to your health or medication before future appointments.
An appropriate consultation, assessment and consent process must be completed before treatment is provided. Treatment may be postponed or declined if the practitioner considers that further information, medical advice or clearance is required to provide the service safely.
You will be given an opportunity to ask questions about your assessment and proposed treatment before proceeding.
For clients under the age of 18, appropriate parent or guardian involvement and consent will be required in accordance with the client's age, circumstances and applicable professional guidance.
Treatment consent and the processing of personal and health information are separate matters. Please refer to the OptiMoveTherapy Privacy Notice for details of how your information is collected, used and stored.
7. Contraindications and Right to Refuse Treatment
OptiMoveTherapy and its practitioners reserve the right to postpone, modify or refuse treatment where it is considered inappropriate or unsafe.
This may include circumstances where:
Your medical history or current condition indicates that treatment may be unsuitable.
Further medical advice or clearance is required.
You are under the influence of alcohol or recreational drugs.
You display aggressive, abusive, threatening or inappropriate behaviour.
You are unable or unwilling to provide the information or consent reasonably required for treatment.
Where appropriate, alternative options or recommendations may be discussed.
8. Client Conduct
All clients are expected to treat practitioners and other individuals at the clinic with courtesy and respect.
Aggressive, abusive, threatening, discriminatory or inappropriate behaviour will not be tolerated.
Where such behaviour occurs, the practitioner may terminate the appointment and refuse future bookings where reasonably justified.
9. Treatment Outcomes and Liability
OptiMoveTherapy and its practitioners will take reasonable care to provide services safely and professionally, in accordance with their qualifications, professional standards and scope of practice.
Treatment outcomes vary between individuals. No specific result, improvement or recovery timeframe can be guaranteed.
You are responsible for following relevant advice and informing your practitioner if symptoms worsen or you experience any unexpected reaction following treatment.
Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence.
Nothing in these Terms and Conditions affects your statutory consumer rights.
10. Insurance and Professional Standards
Practitioners providing services through OptiMoveTherapy are responsible for maintaining appropriate professional qualifications, insurance and any relevant professional registration required for the services they provide.
Sports Therapy services are delivered in accordance with applicable professional standards, including those of the Society of Sports Therapists where relevant.
Physiotherapy services are delivered in accordance with the applicable professional standards and registration requirements.
Each practitioner is responsible for working within their individual qualifications, competence and professional scope of practice.
11. Confidentiality and Data Protection
OptiMoveTherapy handles personal information and clinical records in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Client information is managed using appropriate systems, including:
Rehab Guru: Appointment management, client records, consent forms and clinical notes.
Stripe: Payment processing.
Information is treated confidentially and will only be shared where necessary for providing services, with appropriate consent, or where required or permitted by law.
Access to relevant clinical information may be provided to practitioners involved in your care where necessary for the delivery and coordination of services.
Please refer to the OptiMoveTherapy Privacy Notice for full details of how personal information is collected, used, stored, shared and retained.
12. Late Arrivals and Appropriate Attire
Please arrive promptly for your appointment.
If you arrive late, your appointment may need to be shortened to avoid affecting subsequent bookings. The full appointment fee may still apply.
Where appropriate, you may be asked to wear suitable clothing to allow an assessment or treatment to be carried out effectively. For example, shorts may be requested for lower-limb assessments.
Your privacy, dignity and comfort will be respected throughout your appointment.
13. Online and Distance Bookings – Right to Cancel
Where an appointment is booked online or through another method covered by distance-selling consumer legislation, you may have a statutory 14-day cancellation right from the date the contract is entered into.
This statutory right is separate from the 48-hour and 24-hour appointment cancellation arrangements.
If you request that a service begins within the 14-day statutory cancellation period, you may be required to pay for the proportion of the service already provided if you subsequently cancel, where permitted by law.
If a service is fully performed within that period, your statutory cancellation right may end where the required express request and acknowledgement have been obtained.
Any request to begin a service within the statutory cancellation period, and any acknowledgement relating to the loss of the right to cancel once the service is fully performed, will be obtained separately where required.
Nothing in these Terms and Conditions removes or restricts any statutory consumer rights.
14. Changes to These Terms
OptiMoveTherapy may update these Terms and Conditions from time to time to reflect changes to services, business operations or applicable requirements.
The latest version will be made available through the OptiMoveTherapy website or upon request.
Changes will not retrospectively alter the terms of an existing booking unless agreed with the client or required by law.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes will be dealt with by the courts of England and Wales, subject to any applicable consumer rights and protections.
